21 June 2023. The Voivodship Administrative Court in Warsaw dismissed the complaint of P4 Sp. z o.o., the legal successor of Virgin Mobile Polska sp. z o.o. (llc), against the decision of the President of PDPO, which imposed a fine of almost PLN 1.6 million on the company (ref. II SA/Wa 150/23).
In addition, the President of PDPO recently received a justification of the judgment of the Voivodship Administrative Court in Warsaw of 15 November 2022 (ref. II SA/Wa 546/22), which dismissed the complaint of Santander Bank Polska against the decision of the President of UODO to impose a fine of over PLN 545 thousand on the bank.
The authority is winning more and more cases before the courts. In the first quarter of 2023, there were as many as 32 such cases. The data shows that the number of judgments upholding the decisions of the President of the PDPO is more than twice as high as the number of judgments overturning them. In the entire previous year, the ratio was similar.
