Datatilsynet does not consider consent to be an adequate legal basis for the use of covid passports

The Norwegian supervisory authority states that the EU COVID Certificate is a proportionate measure, as it allows for relief from the burden on the state when the alternative would be to maintain strict infection control measures. However, Datatilsynet has stated that it does not consider an individual’s consent to be an adequate legal basis. Norway is preparing legislation that will give counties the possibility to adopt measures to keep infection rates low and to verify so-called green certificates.
